What is a contract of employment?
A contract of employment is an agreement between two parties – an employer and an employee – that outlines the rights and obligations of each. In California, a contract of employment generally includes basic information such as job title, job duties, compensation, and the duration of the job. Additionally, a contract of employment can also specify other details such as performance expectations, benefits, and termination conditions. When an employer and an employee enter into a contract of employment, both are legally obligated to fulfill certain obligations and adhere to certain rights. The employee agrees to perform the job duties specified in the contract and adhere to any rules and regulations established by the employer. In exchange, the employer agrees to pay the employee a predetermined rate of pay for completed work. In most cases, the employee is also entitled to certain benefits, such as vacation time, health insurance, or other perks. A contract of employment is also known as an "at-will" contract, as it outlines the terms of employment that are applicable to both parties. It is important to note, however, that in California, an employee cannot waive any of their rights under the law, even when those rights are not specifically outlined in the contract of employment.
