Yes, a civil union can be dissolved without going to court in California. When two persons in a civil union mutually agree to dissolve the union, they can do so without going through litigation. The two persons must sign a form called a Declaration of Dissolution of the Civil Union. This form is available from the Secretary of State’s website. After the form is signed, it must be filed with the county where the civil union was registered. Once the county has received and processed the form, the civil union will be officially dissolved. The county may have a list of fees associated with filing the form. Filing the Declaration of Dissolution of the Civil Union is the only legal requirement to dissolve a civil union in California. No court appearance is necessary. Upon dissolution of the civil union, the two parties’ rights and responsibilities to each other are terminated.
