What is civil procedure?
Civil procedure is the legal process that is used when two parties take part in a legal dispute. This process is a series of steps which are used to resolve the dispute and the outcome is based on a ruling by a judge or a jury. In Virginia, civil procedure is governed by the Virginia Rules of Civil Procedure. This process starts with the plaintiff filing a complaint which states the basis of their legal claim and the relief they are seeking. The defendant then has the opportunity to respond with an answer or a motion, such as a motion to dismiss or summary judgment. After pleadings and motions are filed, there is a period of discovery which allows each side to gain information from the other through depositions, interrogatories, and requests for documents. The pre-trial stage of civil proceedings can involve settlement negotiations, motions for relief and the filing of any other relevant documents. If a settlement is not reached, the case will proceed to trial. In trial proceedings, both sides have the opportunity to present evidence and call witnesses to support their case. After the trial, the judge or jury will make a ruling based on the evidence and arguments presented. Civil procedure is an important legal process that ensures both parties in disputes are treated fairly and given the opportunity to present their case. This process helps to ensure that disputes are resolved in an orderly and efficient manner.
