What is alternative dispute resolution (ADR)?

Alternative dispute resolution (ADR) is a way of settling legal disputes outside of the traditional court system. In Indiana, ADR is becoming more popular as an alternative to costly and lengthy court cases. ADR is a generic term for conflict resolution methods that are used to help prevent or end disputes without having to go to court. This might include mediation, arbitration, negotiation, or other methods. In mediation, both parties agree to use a neutral third party, called a mediator, to help them come to an agreement on their dispute. The mediator helps the parties explore options, find common ground, and create solutions that are acceptable to both parties. In arbitration, two parties agree to submit their dispute to an impartial third party, the arbitrator. The arbitrator reviews the facts of the case and makes a decision that is legally binding on the parties. Negotiation is a process in which both parties enter discussions to try to find a solution to their dispute. Both parties present their positions and come to an agreement that they both find acceptable. ADR can be beneficial because it often results in a faster resolution than going to court. Additionally, it can be less expensive, and it gives the parties more control over the process.
