What are the challenges to a summons?

A summons is a court document served to a defendant in a civil proceeding. In Hawaii, a summons is governed by Rules 4 and 4.1 of the Hawaii Rules of Civil Procedure. The purpose of a summons is to notify the defendant of the legal proceedings against them and to designate the time and court in which the defendant must respond. There are several challenges a defendant may face when served with a summons. First, if the defendant is not properly served with the summons, the defendant is not legally bound to respond. In Hawaii, to serve a summons, the plaintiff must have the summons delivered to the defendant personally or by certified mail.
