What is a motion to intervene?

A motion to intervene is an action taken in civil procedure in Michigan that allows a third-party to become involved in a lawsuit between two other parties. This motion allows the third-party to join one of the parties as an additional plaintiff or defendant in a case, even if they were not originally named as a party in the lawsuit. The main purpose of this motion is to ensure that any relevant parties are added to a suit before a final ruling is made. In order for the motion to be granted, the third-party must be able to demonstrate that their involvement is necessary for the case to be ruled on fairly. That is, the court must determine that the third-party has an interest in the case that may be adversely affected by the final ruling in the case. In addition, the party filing the motion must show that they have a valid legal right to intervene in the case before the final ruling is made. If granted, the motion to intervene permits the additional party to become an official party in the lawsuit and take part in all proceedings and hearings related to the case. This allows the court to consider any relevant arguments or evidence that the intervening party may have that could affect the outcome of the case. Although it is ultimately up to the court to determine the validity of the motion to intervene, it can be a helpful tool for ensuring that all parties involved in a lawsuit are given the opportunity to have their voice heard.
