What remedies exist for sex discrimination in the workplace?
In Washington, remedies for sex discrimination in the workplace exist in Federal and State civil rights laws.The Federal Civil Rights Law, Title VII of the Civil Rights Act of 1964, prohibits employers from discriminating against individuals based on their gender, including discrimination in hiring, promotions, and wages. To combat sex-based discrimination, Title VII of the Civil Rights Act of 1964 also prohibits employers from implementing policies or practices that have a disparate impact on individuals based on gender. In addition to the Federal law, Washington State has its own civil rights laws that prohibit discrimination on the basis of sex in employment. Washington State Law Against Discrimination (RCW 49.60) also prohibits employers from discriminating against individuals based on gender. This law prohibits employers from engaging in different treatment of individuals based on their gender, including in the areas of hiring, promotions, wages, discipline, and termination decisions. Employers can also be held liable for discrimination against employees based on the conduct of their customers or vendors. If an employee believes they have been discriminated against on the basis of their gender, they can file a complaint with the Equal Employment Opportunity Commission (EEOC), or the Washington State Human Rights Commission (WSHRC), depending on the type of employer. The EEOC will investigate the complaint and may require the employer to respond to the complaint or provide remedies if a violation is found. Individuals also have the right to file a private civil lawsuit against the employer in some cases. Remedies for sex discrimination in the workplace exist to protect individuals from unjust discrimination.
