In Indiana, civil rights protections exist for workers subjected to workplace retaliation. Generally, retaliation occurs when an employer takes action against an employee because that employee has asserted their legal rights under civil rights laws. Some of these legal rights include the right to be free from discrimination and harassment in the workplace, the right to be paid fairly, the right to a safe working environment, and the right to file a complaint or take other legal action against an employer for wrongdoing. Employees in Indiana are protected from workplace retaliation by both federal and state laws. Under the federal Civil Rights Act of 1964, employees are protected from retaliatory action when they have engaged in a "protected activity" to oppose discrimination or to seek relief from discrimination in the workplace. Additionally, the Indiana Civil Rights Law of 1977 prohibits employers from retaliating against employees for filing discrimination complaints, testifying in proceedings, or generally opposing unlawful practices. In Indiana, employers are prohibited from terminating or otherwise retaliating against employees who file discrimination complaints, testify in proceedings, or oppose discrimination in any manner.
