International conventions governing cybercrime are treaties, conventions and agreements that have been agreed to and adopted by a variety of countries. These conventions are in place to promote global cooperation, information exchange and mutual legal assistance when it comes to cybercrime. The general purpose of these conventions is to protect the public from internet-related crimes including hacking, fraud, and online identity theft. The three main international conventions governing cybercrime are the Council of Europe Convention on Cybercrime (known as the ‘Budapest Convention’), the United Nations Convention against Transnational Organized Crime and the International Telecommunication Union’s Global Cybersecurity Agenda. The Budapest Convention is the only international treaty focused on criminalizing certain cyber-related activity and providing the legal framework for cooperation between nation-states in criminal matters. It requires signatory countries to criminalize certain cybercrimes and to cooperate in investigating and prosecuting those crimes. California is one of the countries that has signed the Budapest Convention. The United Nations Convention against Transnational Organized Crime is an international agreement aimed at preventing, suppressing and punishing transnational organized crimes, which includes cybercrime. The International Telecommunication Union’s Global Cybersecurity Agenda is a framework to address technical and policy measures to support countries in addressing the challenges of cyber threats. Overall, these international conventions provide the legal framework and guidance to better enable countries to work together to protect the public and fight cybercrime.
