What is a product liability lawsuit?

A product liability lawsuit is a type of legal action that is brought against a manufacturer or distributor of a product when the product is unsafe and causes harm to someone. These suits are often used to recover damages caused by a defective product. Under the law of Utah, a product is considered defective if it is not reasonably safe for its intended use. In addition, the manufacturer has a duty to make sure that its products are safe for use. If they fail to do so, and someone is harmed as a result, they can be held responsible. In other words, they must show that the manufacturer knew or should have known about the risk of the product, but failed to take steps to prevent it. If the claimant can prove that, then the manufacturer may be liable for any damages incurred.
