What is the difference between a manufacturer’s defect and a design defect?

In the state of California, the Dangerous Products Law allows people who suffer injuries from dangerous products to hold the manufacturer responsible. The law distinguishes between two types of defects, which determine how damages are awarded: a manufacturer’s defect and a design defect. A manufacturer’s defect is a flaw in the product that is the result of mistakes made during the manufacturing process. This means that even though the product was designed correctly, an error was made during construction. It could be an error in material choice, or a mistake made while assembling the product. A design defect is a flaw in the product that was present during its development. This means that either the designer or engineer made a mistake while creating the product, or an issue with the product design itself caused it to be dangerous. Both of these defects can lead to serious injuries and may require compensation, but the exact damages awarded will depend on the type of defect. For example, if a manufacturer’s defect is to blame, the manufacturer may be liable for any losses caused. On the other hand, if a design defect is found, the designer or engineer of the product may be held responsible as well.
