What is the Uniform Product Liability Act?

The Uniform Product Liability Act (UPLA) is a law in Oklahoma that applies to products that are dangerous to consumers in some way. UPLA has been adopted by the Oklahoma legislature to provide clear standards for product liability claims. The purpose of the act is to protect the public from harm caused by defective products. Under UPLA, a person injured by a defective product can sue the manufacturer, distributor, and/or retailer of that product. This means the manufacturer, distributor, and/or retailer can be found liable for any losses the injured person incurs. A person can recover damages for such losses as medical bills, lost wages, or even pain and suffering. UPLA also sets out the conditions manufacturers must meet to be held liable. These include providing a product that is fit for its intended purpose and is free from manufacturing defect, or a product that carries a known risk that is not properly disclosed or avoided. UPLA also applies a strict-liability standard, meaning the manufacturer cannot avoid liability by proving it was not negligent in its design or manufacture of the product. Ultimately, the UPLA helps protect consumers from dangerous products in Oklahoma. By setting out specific standards for product liability claims, the law helps ensure that those injured by a faulty product can be compensated for their losses.
