What are the legal consequences of a drunk driving violation?
In North Dakota, the legal consequences for a drunk driving violation are severe. According to North Dakota law, a DAB (Driving Under the Intoxication) conviction can result in a one-year loss of driving privileges, as well as fines of up to $1,000 and up to 30 days in jail. Additionally, drivers convicted of a DAB may be required to attend court-mandated addiction treatment programs, and must comply with the state’s ignition interlock device law. In some cases, a conviction for DAB may also result in enhanced or additional criminal penalties. In addition to criminal penalties, those convicted of a DAB may also be subject to civil liability for damages caused by their violation. Those damages may include the costs of medical bills, lost wages, pain and suffering, emotional distress, and punitive damages. In certain cases, the victim of a drunk-driving accident may also be able to sue for additional damages, such as loss of consortium or loss of inheritance. Regardless of the potential civil and/or criminal penalties, the best way to avoid a DAB is to avoid driving after consuming alcohol. Those who choose to drive after drinking should know that law enforcement officers in North Dakota are on the lookout for intoxicated drivers, and those who are caught may face the legal consequences that come with a drunk driving violation.
