Is a suspended license required for a DUI conviction?

Yes, a suspended license is required for a DUI conviction in North Dakota. All individuals convicted of Driving Under the Influence (DUI) are subject to suspension or revocation of their driver’s license. The length of the suspension is determined by the North Dakota Department of Transportation (DOT). Generally, the driver’s license will be suspended for two months for a first-time DUI offense, three months for a second DUI offense, and six months for a third offense. A fourth offense carries a one-year suspension. However, the penalty for a DUI conviction could be as much as two years in jail, with an administrative one-year license suspension. In addition, drivers who are convicted of DUI and have a blood alcohol level that is higher than the legal limit of 0.08% must also install an ignition interlock device (IID) in their vehicle. The IID requires the driver to blow into it to detect alcohol before the vehicle will start. If the driver refuses to submit a sample, or if the device detects alcohol at any time, a violation is recorded. Violations resulting from a failure to comply with the IID requirements could result in additional license suspensions.
