Can a debt collector tell me to pay more than I owe on a debt?

In Tennessee, a debt collector cannot legally require you to pay more than you actually owe on a debt. Tennessee debt collection law prohibits debt collectors from asking for excessive amounts from debtors. This means that, even if a debt collector makes an error in their calculations, they cannot require more money than what is actually due. Furthermore, if a debt collector does attempt to collect an amount that is higher than is owed, they could be subject to fines and other legal action. The Tennessee Department of Commerce and Insurance, Consumer Resources Division is the entity responsible for enforcing the laws regarding debt collection in Tennessee. Debtors who feel they have been overcharged or subjected to aggressive and unfair collection tactics can contact the Consumer Resources Division to file a complaint. It is important to note that a debt collector might offer to settle your debt for less than the total amount owed. If you agree and make a payment, you must ensure that the debt collector is aware that they are accepting the payment as a full settlement of the debt. Otherwise, you may end up owing more money than you originally agreed to pay. Ultimately, Tennessee debt collection law does not allow debt collectors to require more payment than is actually owed on a debt. If you believe that a debt collector is attempting to unlawfully collect an amount greater than what is due, contact the Consumer Resources Division for assistance.
