Can a debt collector contact me at any time of day?

In Oregon, debt collectors are restricted in the times during which they can contact someone in pursuit of a debt. Under the Oregon Unlawful Debt Collection Practices Act, debt collectors are prohibited from contacting a debtor before 8am or after 9pm, local time for the debtor. This is applicable to any form of contact, such as phone calls, emails, text messages, or mail. Furthermore, the collector may not contact the debtor on a Sunday or legal holiday. If a debt collector intentionally contacts a debtor outside of permissible times, the debtor may be able to take legal action against the collector. It is important to note, however, that debt collectors may contact debtors at any time if a court has already approved the debt collection. In Oregon, debt collectors are also restricted in terms of how often they can contact someone regarding a debt. Debt collectors may not contact the debtor more than three times a week unless the debtor has explicitly agreed to more frequent contact. Generally speaking, as long as a debt collector is following the rules concerning contact times and frequencies, they are allowed to contact a debtor for a legitimate debt. It is important for debtors to be aware that debt collectors must follow the rules and may not contact at any time of day. Debtors who feel that a debt collector is not following the rules have the right to take legal action against them.
