Yes, a debt collector can contact you if you are a student in Tennessee. The Fair Debt Collection Practices Act (FDCPA) is a federal law that limits the actions a debt collector can take when trying to collect a debt. According to the FDCPA, debt collectors must refrain from harassing or oppressive behavior when contacting a debtor, including students. However, the FDCPA does provide some protection to students from debt collectors. If you are a student under the age of 21 and are still in school, the debt collector must provide a written notice of your rights before contacting you. This notice must provide information regarding your right to dispute the debt and have verification of the debt, your right to obtain the name and address of the original creditor, and your rights to have the debt collector stop contacting you until the debt is verified. Debt collectors are also prohibited from contacting you before 8 am in the morning or after 9 pm at night.
