What are my rights as a disabled employee?
As a disabled employee in Delaware, you are protected under the Americans with Disabilities Act (ADA). This federal law prohibits employers from discriminating against individuals based on disability in areas including job application processes, hiring, firing, pay, job assignments, and promotion. Additionally, the ADA requires employers to provide reasonable accommodations to qualified individuals with disabilities. Reasonable accommodations are modifications or adjustments to a job, the work environment, or the way things are usually done, in order to enable an employee with a disability to perform their job duties. Under Delaware disability law, employers are required to make reasonable accommodations for disabled employees in order to make it easier for them to fulfill their job duties, as long as the accommodations do not place an undue burden on the employer. Some examples of reasonable accommodations could include providing special seating or desks, modifying work schedules or job duties, implementing assistive technology, or providing interpreters for employees with hearing impairments. If you believe you have been discriminated against or denied reasonable accommodations due to your disability, you have the right to file a complaint with the Delaware Department of Labor or the U.S. Equal Employment Opportunity Commission. The ADA also prohibits retaliation against employees who file a complaint or oppose discrimination. We highly recommend you seek legal assistance to better understand your rights and legal options.
