What is an employment nondiscrimination law?

An employment nondiscrimination law is a law that prohibits employers from discriminating against an individual based on certain characteristics. In Delaware, these characteristics include race, color, religion, sex, age, national origin, disability, marital status, sexual orientation, gender identity, genetic information, or veteran status. These laws also prohibit employers from requiring an individual to take any action related to their disability that would not be required of any other employee, such as asking for medical documentation or requiring the individual to answer specific questions about their disability. Additionally, employers cannot refuse to hire an individual because of their disability, nor can they terminate them because of it. An employer also cannot deny reasonable accommodations to an employee with disabilities unless doing so would impose an undue hardship on the employer. These laws are intended to ensure that all individuals have equal access to employment opportunities, regardless of their disability status.
