What is an employment nondiscrimination law?

An employment nondiscrimination law is a law that protects individuals with disabilities or special needs from being treated unfairly in the workplace. In New Mexico, the disability law prohibits employers from discriminating against an applicant or employee on the basis of their disability. This means that an employer cannot refuse to hire an individual simply because they have a disability, or treat an individual differently in any way based on their disability. The law also requires employers to provide reasonable accommodations for the individual’s disability. This includes making sure that the individual has the appropriate equipment or other resources needed to perform their job, or changing the job duties if the disability prevents the individual from completing them in their original form. Finally, the law also prohibits employers from refusing to promote or hire an employee or applicant based on their disability or using the disability as a factor in determining an employee’s pay. All of these protections are in place to ensure that individuals with disabilities or special needs are given the same chance for success that everyone else has in the workplace.
