What is the process for filing a disability discrimination complaint?

In Minnesota, if someone believes they have been discriminated against on the basis of a disability, they can file a complaint with the Minnesota Department of Human Rights (MDHR). To do so, an individual first needs to contact MDHR and inform them of their intention to file a disability discrimination complaint. MDHR will then provide the individual with the complaint form and instructions. The individual will then need to fill out the form and provide details including the name of the person or organization accused of discrimination, the date of the alleged incident, and a detailed description of the discrimination. Once the complaint has been filed, the MDHR will review the complaint and decide whether to proceed with an investigation. If MDHR decides to proceed, they will send the accused a copy of the complaint and ask them to respond. After the accused has given their response, MDHR can decide to conduct an impartial investigation or to resolve the issue with the parties. If an investigation is conducted, MDHR will investigate the claim, review any relevant documents or evidence, and hear testimony from the parties. Based on their investigation, MDHR can decide to dismiss the complaint or to issue a resolution. If the complaint is dismissed, the individual can still pursue other options, such as filing a lawsuit in court. If the complaint is resolved through MDHR, the resolution may include compensation or corrective actions.
