What are the eligibility requirements for the Americans with Disabilities Act?

The Americans with Disabilities Act (ADA) is a federal law that protects individuals with disabilities from discrimination in the workplace, public accommodations, transportation, state and local government services, and telecommunications. In Utah, the ADA applies to all employers, state and local government entities, places of public accommodation, and telecommunication services. To be eligible for protection under the ADA, an individual must be a qualified individual with a disability. A qualified individual is defined as a person who can perform the essential functions of the job with or without reasonable accommodation. A disability is defined as a physical or mental impairment that substantially limits one or more life activities, has a record of such an impairment, or is regarded as having such an impairment. In addition to meeting the qualifications, the individual must also satisfy the requirements of the ADA in order to be eligible for protection. These requirements include: being a US citizen or lawful permanent resident, having been employed for at least 12 months with the same employer, not having been convicted of a crime or having committed any misconduct, and demonstrating knowledge of the ADA. All employers must make reasonable accommodations for persons with disabilities unless doing so would impose an undue hardship on the employer. Reasonable accommodations may include, but are not limited to, making changes to facilities, providing assistive devices, or providing job retraining. In Utah, employers are also prohibited from discriminating against individuals with disabilities in all aspects of employment, including hiring, firing, promotions, wages, and trainings. Employers are also expected to provide reasonable accommodations for qualified employees with disabilities.
