Are employers allowed to ask questions about a person’s disability during a job interview?

In Minnesota, employers are not allowed to inquire as to a person’s disability status during a job interview. There are a few exceptions to this rule, such as if the employer needs to know if the applicant needs accommodations for the interview. The Americans with Disabilities Act (ADA) and Minnesota state disability law prohibit employers from asking job applicants about their disabilities before they have offered the applicant a job. This means employers may not ask applicants about their disability status during the job interview, or inquire about their medical history, when they first apply for a job, or before they have been offered a job. The law also states that employers cannot ask applicants to take a medical exam before they have been offered the job. If employers are concerned about an applicant’s ability to perform a job, they should instead ask questions related to their skills and qualifications. The purpose of these laws is to make sure that people with disabilities are treated fairly and have the same opportunities as everyone else when it comes to employment. If an employer is found to be in violation of these laws, they may be subject to fines or other penalties.
