Are employers allowed to deny jobs to people with disabilities?
In Idaho, employers are allowed to deny jobs to people with disabilities, but in certain instances, they must provide a reasonable accommodation to the disabled person to make the job feasible. According to the Americans with Disabilities Act (ADA), employers cannot refuse to hire someone because of their disability if they can do the essential functions of the job with or without reasonable accommodations. This means that the employer must make any reasonable modifications or changes to the workplace or job duties that will enable the disabled person to perform the job. Employers must also provide reasonable accommodations if a disabled applicant needs an accommodation to perform the essential job functions. This could include providing adaptive equipment, allowing for flexible hours, providing additional training or allowing for a longer application process. However, employers do not have to provide an accommodation if it would create an undue hardship on the business, such as placing an excessive financial burden on the business. Ultimately, it is up to the employer to make a determination on whether or not to provide an accommodation to a disabled individual, and they are allowed to deny a job to someone based on their disability if they feel it is necessary.
