Are employers allowed to ask questions about a person’s disability during a job interview?
Generally, employers in Idaho are not allowed to ask questions about a person’s disability during a job interview. This is because of the Americans with Disabilities Act (ADA) and a few other disability-related laws. Under this law, employers can only inquire about an applicant’s ability to perform the essential job duties of the position. They are unable to ask about an applicant’s disability status or require them to take a medical exam until they offer the applicant a job. Discriminatory questions about a person’s disability status during a job interview are prohibited. Employers must respect an applicant’s request for reasonable accommodations during the interview process or the prospect of being hired. Questions about whether an applicant is able to use public transportation may also violate the ADA, as this may indicate a disability. In general, employers cannot discriminate against people with disabilities during the job application process. Injury or illness that is not disabling is generally not a factor in the hiring decision and must not be asked about in an interview. If an applicant requests an accommodation, an employer must grant it unless it would cause undue hardship to the employer.
