What is the difference between possession and trafficking?

Possession and trafficking of drugs are two distinct crimes under Utah law. Possession of drugs generally refers to someone having drugs on their possession that they do not have a legal right to possess. Trafficking, on the other hand, refers to the illegal distribution or sale of drugs. In Utah, possession of drugs is a misdemeanor offense, meaning the maximum penalty for a first-time offender is up to one year in jail and/or a fine of up to $2,500. A second offense can bring a penalty of up to five years in prison and/or a fine of up to $5,000. Drug trafficking is a much more serious offense that can carry much more severe penalties. Depending on the type and quantity of drugs in possession, offering to distribute (or conspiracy to distribute) drugs is a felony offense that could carry a sentence of up to 15 years in prison and/or a fine of up to $10,000. Penalties for drug trafficking increase with the quantity of drugs in possession, and those found guilty can be facing up to life in prison. In general, possession simply means that someone had a drug on their person, while trafficking indicates that someone had the intent to sell or distribute the drug. Both are serious offenses under Utah law, and a conviction can have life-changing consequences.
