What is Disability Planning Law?

Disability Planning Law is a set of laws in California that help families and individuals with disabilities plan for their future. They provide an array of services and resources that help protect and secure the financial future of those with disabilities and ensure they can maintain their quality of life. Things like special needs trusts, advance health care directives, guardianship, and conservatorships are all addressed by disability planning law. A special needs trust is a trust that is specifically set up to provide financial resources to someone who is disabled. This trust is designed to supplement government benefits, like Medicare and Social Security, so that people with disabilities can have access to supplemental medical and/or other necessities. Advance health care directives, guardianship, and conservatorships all provide steps and guidelines to help ensure the person with a disability will receive the care and protection they need. Advance health care directives give instructions for what medical treatments a person with a disability would want if they become incapacitated. Guardianship is a legal document that allows a person to make decisions for someone with a disability. Conservatorship is a legal document that allows a person to manage the financial affairs of someone with a disability. Together, these laws provide families and individuals with disabilities a plan to ensure they will be provided for. Disability Planning Law can provide support and security to those who need it in California.
