What is a health care proxy?

A health care proxy is a legal document used in the state of California for disability planning law. The health care proxy enables an individual to designate another person to make health care decisions on their behalf, in the event that the individual is unable to make those decisions themselves. The proxy is typically an adult family member, close friend, or other qualified individual, who will act on behalf of the individual should they be unable to do so themselves. The health care proxy document must be clearly written and approved by a notary in California for it to be legally binding. The person being designated as the proxy should be fully informed of the individual’s wishes and beliefs. They should have knowledge of the individual’s preferences and be able to make decisions based on those, should the individual become incapacitated. The health care proxy may also be called a “durable power of attorney for health care” or “advance directive.” This document can be invaluable in the event that the individual becomes unable to make their own health care decisions. It outlines who has the right to make decisions on their behalf and can provide peace of mind to the individual who may have to suffer through a medical emergency or extended illness.
