What can a Durable Power of Attorney do?

A Durable Power of Attorney (DPOA) is a legal document in California that gives someone else the power to make decisions on your behalf in the event that you are incapacitated or unable to make decisions due to disability. The person you give this power to is called an “attorney-in-fact”. This attorney-in-fact is legally empowered to manage your healthcare, finances, business matters, and other legal decisions. Your attorney-in-fact can also manage your financial affairs and make decisions about your estate. For example, your attorney-in-fact can deposit and withdraw funds from your bank accounts, buy and sell property on your behalf, and even file taxes. In the event that you become incapacitated and unable to make decisions for yourself, a DPOA provides an important legal tool to ensure that someone else can take on that responsibility. This ensures that your wishes are carried out and that you are treated according to your wishes. While a DPOA is legally binding and powerful, it is important to note that it is only valid while you are alive. Upon your death, it becomes invalid and no longer has any legal power.
