How do I apply for a Guardianship?

In order to apply for a Guardianship in California, you must first file a petition with the court. This petition must state your name, address, and relationship to the disabled individual. It should also include a statement explaining why the Guardianship is necessary. Once the petition is filed, the court will review it and decide whether or not the Guardianship is necessary. If the court decides a Guardianship is necessary, they will appoint a Guardian to manage the disabled individual’s personal and financial affairs. The Guardian will be responsible for making sure the disabled individual’s wishes and needs are addressed. The Guardian will also be responsible for filing all necessary paperwork and keeping the court updated on the disabled individual’s progress. They must also make sure the disabled individual gets all the medical and psychological care they need. If you are applying to become a Guardian, you will need to provide proof of your relationship to the disabled individual, as well as references from other people who know the disabled individual. You will also need to fill out financial and medical forms. You may need to provide additional information such as psychiatric evaluations, and have the court’s approval. It is important to note that Guardianship is a serious step for both the disabled individual and the court. The court will review all the information carefully and make sure the Guardianship is in the best interest of the disabled individual.
