What is the definition of a disability?
In California, disability is defined as any physical or mental condition which affects an individual’s ability to perform daily activities, such as walking, seeing, hearing, speaking, breathing, learning, or taking care of oneself. It includes physical and mental disabilities both visible and hidden. Under disability planning law in California, a disability is defined in a legal context as a physical or mental impairment that substantially limits one or more major life activities, such as self-care, walking, seeing, hearing, speaking, learning, or working. It also includes physical and mental impairments that substantially limit the ability of an individual to perform a major life activity, or to participate in a major life activity. Disabilities may also include those caused by developmental, mental, or emotional problems, including autism, attention deficit disorder, and learning disabilities. In addition to physical and mental impairments, the definition of a disability may also include any physical or mental condition which significantly limits a person’s ability to perform daily activities, such as walking, speaking, learning, or taking care of oneself. In order to qualify for disability planning law in California, an individual must meet the definition of a disability as outlined in the California Fair Employment and Housing Act. This act covers all individuals with disabilities, regardless of their age, race, color, religious creed, national origin, ancestry, marital status, sex, or sexual orientation.
