What can a Durable Power of Attorney do?
A Durable Power of Attorney is a legal document that allows someone (the Principal) to appoint someone else (the Attorney-in-Fact) to act on their behalf with regards to matters specified in the document. In Nevada, this document can be used to make decisions for a person with disabilities who may not be able to make those decisions for themselves. The Durable Power of Attorney can be used to determine what kind of medical care the Principal will receive, where they will live, who will take care of them, and how their assets will be managed. It is also used to appoint a representative who will speak on behalf of the Principal in any legal matters. The documents may also include the ability to manage any personal financial, tax, or investment matters in the name of the Principal. The Durable Power of Attorney in Nevada is also used in Estate planning, in which case it can authorize the Attorney-in-Fact to handle all estate matters pertaining to the Principal, such as the management of all assets and finances, filing of tax returns, settlement of debts, and planning for long-term care. Ultimately, it gives the Attorney-in-Fact a wide range of power to handle all of the matters pertaining to the Principal in a responsible manner according to the Principal’s wishes.
