What is a guardianship?

A guardianship is a legal proceeding that is used to appoint a guardian for an individual with a disability. In California, a guardianship is used when an individual is unable to make decisions for themselves due to a mental condition or disability. When an individual is determined to be unable to make decisions for themselves, a court will appoint a guardian for them. The guardian is given the legal authority to make decisions for the individual on their behalf. The guardian is responsible for making decisions on behalf of the individual regarding their personal and financial matters. The guardian must act in the best interest of the individual and ensure that all decisions are made with the individual’s best interest in mind. The guardian is also responsible for making sure the individual’s medical, educational, and personal needs are met. The court that oversees the guardianship will monitor the guardian’s performance to make sure the individual’s best interest is always a priority. The court can order a guardian to take certain actions, such as providing a specific level of care for the individual, and the court can also remove a guardian if it feels the individual’s best interest is not being served. Overall, guardianships are important tools for providing assistance to individuals with disabilities and ensuring their well-being and safety. Guardians are responsible for making decisions that are in the best interest of the individual, and it is the responsibility of the court to ensure that this is done.
