What is the difference between a guardianship and a conservatorship?

The main difference between a guardianship and a conservatorship in Rhode Island is the scope of responsibility. A guardianship is a legal relationship where an adult is appointed by the court to make decisions for a minor. As guardian, the adult would have the authority to make decisions about the minor’s medical care, educational goals and activities, and other matters that affect the minor’s daily life. A conservatorship is a legal relationship where an adult is appointed by the court to make decisions for an adult who is unable to do so on their own. As conservator, the adult would have the power to make decisions about the individual’s financial management, investments, and property. The conservator may also be asked to advise the court on behalf of the protected person. In Rhode Island, both guardianship and conservatorship are important aspects of disability planning law. Both of these arrangements allow individuals with disabilities to have their legal and financial matters managed in a way that keeps their best interests at the heart of the decision-making process. In the event of incapacity, these arrangements can transfer responsibility to another person and offer protection for the disabled individual.
