What is a special needs trust?
A special needs trust (SNT) is a legal tool used in disability planning law in Georgia that provides for the financial needs of disabled individuals. It is designed to protect a disabled individual’s eligibility for government programs like Supplemental Security Income (SSI) and Medicaid while also ensuring that the individual’s quality of life is maintained. An SNT is managed by an appointed trustee and funded by contributions from individuals or organizations. The trust is designed to supplement, not replace, government benefits and can give the beneficiary access to many items that government programs cannot provide, such as recreational activities, additional transportation, or even private care services. Funds placed in an SNT are not counted towards the beneficiary’s total income, and therefore, do not impact their eligibility for government benefits. The trust can provide a long-term solution to providing for the needs of an individual with a disability, ensuring that they are taken care of financially in the future.
