What is an administrative license suspension?

An administrative license suspension (ALS) is a suspension of driving privileges that is issued by a law enforcement officer without going to court. In Minnesota, the ALS process is administered by the Department of Public Safety Driver and Vehicle Services Division (DVS). When a driver is arrested for driving under the influence (DUI), the officer will confiscate their driver’s license and issue them a temporary license valid for seven days. During this time, the accused will receive a notice from DVS that their license is being suspended for 90 days. At this point, the accused has the right to request a hearing to appeal the ALS. In most cases, the accused will have to prove that there was an error or that the suspension is unlawful or unjustified. During the hearing, both the accused and the arresting officer will present arguments and evidence. The hearing officer’s decision is final and will either reinstate the driver’s license or uphold the suspension. If the license is suspended, the driver is prohibited from operating any motor vehicle until the suspension period has ended. Furthermore, if the driver is convicted of DUI, they may face additional license suspension or revocation.
