What is the difference between a drug DUI and an alcohol DUI?

In Minnesota, a DUI (driving under the influence) is a criminal offense when an individual operates a vehicle while impaired by a drug or alcohol. DUI offenses are separated into two categories: drug DUIs and alcohol DUIs. The primary difference between a drug DUI and an alcohol DUI is the substance in question. A drug DUI involves operating a vehicle while impaired by any illegal, legal, or prescription drugs, such as marijuana, steroids, or opioids. This includes both illicit drugs and drugs obtained with a prescription. An alcohol DUI, on the other hand, involves operating a vehicle while impaired by any amount of alcohol. This can include beverages such as beer, wine, and hard liquor. Although Minnesota has a zero-tolerance policy for both drug and alcohol DUIs, the penalties for each vary. Drug DUIs are more severe and could result in harsher punishments like longer jail time, higher fines, longer suspensions or revocations of driving privileges, and higher insurance premiums. Alcohol DUIs typically result in the same penalties, but in some instances, such as Minnesota’s implied consent law, may have a lesser penalty than a drug DUI. Both drug DUIs and alcohol DUIs come with serious consequences. Regardless of the type of DUI, those convicted of the offense face severe penalties and can have their lives disrupted in a multitude of ways. If you or a loved one has been charged with a DUI, it is important to seek help from a qualified attorney who can advise you on the best course of action.
