What are the different types of DUI charges?
In Minnesota, there are three types of DUI charges that can be brought against a driver. The first is Operating a Motor Vehicle under the Influence of Alcohol (“OMVI”). This charge is used when a blood alcohol concentration of .08 or higher is detected by a breathalyzer test or other method of testing. This charge is a criminal offense and can lead to serious penalties, including jail time, fines, and license suspension. The second type of DUI charge is Driving While Impaired (“DWI”). This charge can be used when a driver is impaired by alcohol but does not meet the level of intoxication necessary for an OMVI charge. A DWI is a gross misdemeanor and carries similar penalties as an OMVI. The third type of DUI charge is Driving After Cancellation (“DAC”). This charge applies when a driver has had their license revoked or canceled due to a prior conviction of DUI or DWI, and then drives in violation of that revocation or cancellation. Conviction of a DAC can lead to jail time, fines, license suspension, and other penalties. All three DUI charges carry the potential for serious penalties, which is why it is important to understand the different charges and to never get behind the wheel of a car after drinking. If you or a loved one have been charged with DUI in Minnesota, it is important to seek the advice of a qualified DUI attorney as soon as possible.
