What is an administrative license suspension?

An administrative license suspension (ALS) is a penalty imposed on drivers in Virginia who are arrested for driving under the influence (DUI). It is an administrative action taken by the Virginia Department of Motor Vehicles (DMV). When a driver is arrested for suspicion of DUI, the arresting officer can take their driver’s license and issue an ALS letter. This letter states that the driver will lose their license for a certain period of time, usually between 3 and 12 months, unless they request an administrative hearing. At the hearing, the driver can challenge the suspension on legal grounds, such as arguing that they weren’t given the right to refuse a breath test or that the arresting officer didn’t follow proper procedure. If the driver is successful in their appeal, the suspension will be removed and their driving privileges will be reinstated. If the suspension is upheld, the driver must wait out the suspension period before they can get their license back. During this time, they cannot legally operate a motor vehicle. In addition to the suspension, they may face other penalties as a result of their DUI arrest. An administrative license suspension is an important reminder of the serious consequences of drinking and driving. It is important for drivers in Virginia to remember that drinking and driving is a crime that carries serious penalties.
