What is the penalty for a third DUI conviction?
In the state of Virginia, a third DUI conviction carries with it a felony charge. This is an incredibly serious offense and the penalties for such an offense are severe. If convicted, an individual may face a fine of up to $2,500 and/or a 24-month jail sentence. It is also likely that the individual will be placed on supervised probation for a period of three years or more. In addition, the individual may also have their driver’s license suspended for an additional period of time. This may be a minimum of three years or as long as life in some cases. If the individual chooses to drive on a suspended license, they can face further charges and penalties. Moreover, the individual may be required to attend a special program for a minimum of three months set up by the Virginia Alcohol Safety Action Program (VASAP). Such a program would include classes on alcohol safety, an assessment and treatment of the individual, and ongoing monitoring and evaluation of the individual’s progress. Finally, a third DUI conviction in Virginia can have serious, lifelong consequences. This can include difficulty finding employment or housing or even potential travel restrictions.
