Can a DUI be expunged from my record?

In the state of Virginia, you can petition the court to expunge a DUI conviction from your criminal record. An expungement removes a DUI conviction from your criminal record and makes it difficult for employers or others to gain access to information about the charge. However, expungement is not available to everyone and you must meet certain requirements to be eligible. To qualify for expungement, you must have received a suspended sentence of less than twelve months, and a fine of less than $2,500, for a first offense DUI. Additionally, you must have no other convictions or pending charges, and must have completed any associated probation and/or court-ordered programs. If you meet the eligibility requirements, you must still submit an expungement petition to the court and appear in court for a hearing. If the judge grants your petition, the DUI will be removed from your criminal record. It is important to be aware that although a DUI can be expunged from your criminal record, it will still appear on your driving record. Furthermore, a DUI conviction cannot be expunged if you were sentenced to serve time in jail or prison. An expungement is a beneficial way to hide a DUI from public record and employers. However, it is important to be aware that expunging your record does not erase the DUI, and you may still face consequences for the conviction if necessary.
