What is the difference between a first and second DUI offense?
The difference between a first and second DUI offense in Washington is significant. A first DUI offense is a misdemeanor offense and is punishable by up to one year in jail, a fine of up to $5,000, and/or a license suspension of 90 days to one year. A second DUI offense is a gross misdemeanor, and is punishable by up to one year in jail, a fine of up to $5,000, and/or a license suspension of two years. Additionally, if a person is convicted of a second DUI offense, they will have to have an Ignition Interlock Device (IID) installed on their vehicle, which will measure the amount of alcohol in their breath and only allow the vehicle to start if the driver passes the test.
