Can I cancel an administrative license suspension?

In Pennsylvania, an administrative license suspension is issued when someone is arrested for driving under the influence (DUI) or refuses to take a chemical test. These suspensions are issued by the Pennsylvania Department of Transportation (PennDOT). In some cases, an individual may be able to cancel an administrative license suspension. If a person files a petition within 15 days of receiving the order of suspension, they may be able to have the suspension withdrawn. The individual will have to make a court appearance to discuss their legal rights and the suspension. The court will then consider if the suspension was issued lawfully. If the court decides it was not, they may reverse the suspension. In addition to filing a petition, an individual may be able to get a limited license if they meet certain criteria. This means they can drive in certain situations, such as to work, school or medical appointments. To qualify for the limited license, the individual must prove that the suspension would cause them undue hardship. Ultimately, whether or not an administrative license suspension can be cancelled depends on the court’s decision and the individual’s unique circumstances. There are options for getting a limited license or having the suspension reversed, but these are not always possible. It is important for anyone facing an administrative license suspension to contact an attorney for help.
