Are there any alternatives to a DWI conviction, such as a diversion program?

In Nebraska, a DWI conviction can have serious consequences for those accused of driving while intoxicated. However, there are alternatives to a DWI conviction that exist in some states, such as diversion programs. A DWI diversion program is a form of probation in which the accused agrees to certain terms, including taking educational courses, attending treatment programs, and submitting to regular breath tests or other required alcohol testing. By successfully completing the diversion program, the accused can avoid a DWI conviction. In Nebraska, the diversion program is available to first-time DWI offenders over the age of 21. In addition, the accused must not have been involved in any prior alcohol-related driving offenses. To be eligible for the program, the accused must also have a blood alcohol concentration (BAC) level below .15% at the time of their arrest. If the accused successfully completes the diversion program, the charge of DWI will be dismissed and the accused can carry on with their life without a conviction. This can be helpful in some cases, as a conviction can affect an individual’s ability to get a job or secure housing. While the program can be beneficial for those accused of a DWI, it can also be difficult to complete as it requires commitment and dedication to the program over a period of time.
