What is the difference between state and federal education law?
The main difference between state and federal education laws is the governing body. State education laws are established by state legislatures, while federal education laws are established by the United States Congress. Generally, states provide the framework for education policy, while the federal government oversees educational standards and policies that apply to all states. State education laws typically address issues such as school funding, curriculum standards, teacher certification, student safety, and school discipline. Federal education laws, however, often address more far-reaching issues such as civil rights, educational equity, student privacy, and special education. In addition, state education laws may be more specific due to their limited scope. For example, Virginia’s education law outlines specific requirements for student assessments, graduation requirements, and school attendance policies. In contrast, federal education laws are often broader in scope, such as the Individuals with Disabilities Education Act (IDEA), which requires all states to provide a “free appropriate public education” to all students with disabilities. Overall, state and federal education laws work together to ensure a quality education for all students, regardless of their circumstances. Although the governing bodies for state and federal education laws differ, both are essential for providing a safe and productive learning environment in all of America’s schools.
