What is the Americans with Disabilities Act?

The Americans with Disabilities Act (ADA) is a federal civil rights law passed in 1990 that prohibits discrimination based on disability. It is applicable in all 50 states, including California. The ADA requires employers, public entities, such as schools and state government, and places of public accommodation, such as restaurants and theaters, to make reasonable modifications for individuals with disabilities so that they can access services. The ADA requires schools in California to provide equal educational opportunities for students with disabilities. Schools must meet the individual needs of students with disabilities by providing a free and appropriate public education (FAPE). This includes making modifications to the classroom, curriculum, and assessments so that they are accessible to students with disabilities. The ADA also requires that schools put in place measures to ensure that students with disabilities have access to all programs and activities at the school. This includes both extracurricular activities and after-school activities. Schools must also make sure that students with disabilities have an equal opportunity to participate in and benefit from these activities. Finally, the ADA prohibits discrimination against individuals with disabilities in any program or activity operated by a public entity, including schools. This means that schools cannot exclude students with disabilities or treat them differently than other students. Schools must also make sure that their learning environment is free of discrimination and harassment.
