What are the rules for write-in candidates?
In North Dakota, write-in candidates must follow rules as set forth in state laws. To be eligible, a write-in candidate must meet the same legal requirements and residency requirements as any other candidate running in the election. In addition, the write-in candidate must submit a Declaration of Intent to run for office no later than 6:00 P.M. on the day of the Primary Election. The candidate must also have written authorization from at least twenty-five registered voters in the same voting district. This documentation must be provided to the county auditor between 6:00 P.M. on the day of the Primary Election and the beginning of the filing period for the General Election. Finally, if the write-in candidate wishes to have their name printed on the ballot, the candidate must submit a Nomination by Petition no later than the beginning of the filing period for the General Election and secure signatures of at least 100 registered voters in the same voting district. If a write-in candidate meets all the requirements, their name will be printed on the ballot and they can be elected if they receive the most votes. However, write-in candidates must be aware that receiving the most votes does not guarantee election as there are some exceptions to this rule. For example, if a write-in candidate does not hold the necessary qualifications for the office or if their written authorization is not properly filed, they may still lose the election.
