What is the difference between a voluntary sale and a forced sale?
The difference between a voluntary sale and a forced sale is significant, especially in regards to Eminent Domain Law in Washington. Generally, a voluntary sale is when an agreement is made between a seller and a buyer in which the seller agrees to sell a property and the buyer agrees to buy that property, usually in exchange for compensation. By contrast, a forced sale occurs when the government uses its powers of Eminent Domain to acquire a property. Specifically, in Washington, Eminent Domain Law allows the state to acquire private property if it is necessary, such as to construct a public building. In these cases, the state must provide just compensation to the property owner, and the sale is not voluntary but instead involuntary and forced. While the property owner does receive compensation, they may not be adequately compensated for the value of their property, and in some cases, may be unwilling to sell. Ultimately, the difference between a voluntary sale and a forced sale is that in a voluntary sale, the property owner agrees to the sale, while in a forced sale, the state uses its power of Eminent Domain to acquire the property.
