What is the difference between wrongful termination and constructive discharge?

Wrongful termination and constructive discharge are two types of actions that can be classified as wrongful termination in Idaho employment law. Wrongful termination is when an employer has unlawfully terminated an employee based on their race, gender, religion, age, or disability. Constructive discharge, on the other hand, is when certain conditions of employment have become so unbearable that an employee is forced to resign in order to escape the situation. Wrongful termination is often easier to prove, as the employer has taken a direct action to end the employment relationship. Constructive discharge can be more difficult to prove, as it must be demonstrated that the employer created an environment so intolerable that the employee had no other choice but to resign. In Idaho, wrongful termination claims may result in both monetary compensation and reinstatement to the job. Constructive discharge claims may only result in the compensation of wages and other benefits the employee would have received had he or she not resigned. Employees who believe they have been wrongfully terminated should contact an experienced employment attorney to discuss their legal options. Constructive discharge claims are difficult to prove, so it is best to consult an employment attorney who can provide guidance and legal representation.
