What is privacy in the workplace?
Privacy in the workplace refers to the legal protections that employees are guaranteed when it comes to their personal information. In Hawaii, employers can’t ask workers about things like their health, religion, race, sexual orientation, or any other protected class. Additionally, employers must keep confidential employee information such as payroll records, personnel files, and medical records secure from unauthorized use. In Hawaii, employers must also abide by the federal law, The Health Insurance Portability and Accountability Act (HIPAA), which sets restrictions on how employers can use and share employee health information. Employers must also provide a safe and comfortable environment for employees to express themselves without fear of discrimination or harassment. Employers should make sure that they don’t ask questions about an employee’s private life, or try to pressure them into revealing information about themselves against their will. Additionally, employers must respect and uphold the rights of their workers to access their own personnel records and keep them confidential. Finally, employers must also abide by the state and federal laws that require them to protect the privacy of their employees. In Hawaii, employers must take steps to protect the private information they collect from employees, such as not using it for any purpose other than the one they collected it for. Additionally, employers are not allowed to send personal information via email or other non-secure methods. Employers must also make sure they keep the workplace free from monitoring or surveillance of employees and their activities.
